457 Visa Category to be Abolished

April 2017

On 18th April 2017, the Australian Government announced that in March 2018 the Temporary Work (Skilled) visa – Subclass 457 visa will be abolished and replaced with a new Temporary Skill Shortage (TSS) visa.

The TSS visa program will be comprised of two streams:

The aim of the new program is to support businesses in addressing genuine skill shortages in their workforce and provide safeguards for Australian workers.

While the 457 visa program is continuing to operate until the introduction of the TSS program, there have been a number of changes to the 457 program effective immediately.

These changes include:

Communication from the Department of Immigration and Border Protection (DIBP) states that applicants who have lodged subclass 457 nomination and visa applications not yet approved under occupations now no longer approved for the purposes of the program will be given the opportunity to withdraw their applications and a refund provided.

For people currently on a 457 visa, there will be grandfathering arrangements introduced which will allow these people to remain in Australia on these visas under the conditions of their current visas.

Subclass 186 (Temporary Residence Transition Stream – TRT) Applications

From the information available at this stage, there appears to be no changes to current 186 (TRT) applications currently in progress.
