Updates to Condition 8547

The Australian Department of Immigration and Border Protection (DIBP) has recently implemented changes that allow working holiday visa holders to work for more than six months with the same employer in certain circumstances.


Condition 8547 applies to working holiday visas and has the effect of limiting work with any one employer to no more than six months. Prior to the recent changes the limitation applied regardless of where the work was performed. The recent changes soften the policy and now allow working holiday visa holders to work for an additional six months for the same employer, as long as the work is performed in a different location.


The new DIBP policy states as follows:

 “Working for longer than six months with the same organisation would generally not be considered consistent with condition 8547. A visa holder may, however, work for the same employer for a combined total of more than six months, provided the work is undertaken in different locations and work in any one location does not exceed six months. Examples include different hotels, resorts or restaurants in the same chain; independently-owned franchises; and separate branches or facilities (such as farms or abattoirs) of the same organisation or business owner. However, working in a different position at the same workplace (for example, changing to a cleaning role after initially working for six months at reception) would be considered a continuation of employment with the same end user”.


As noted in the policy above, this change is helpful for businesses that operate in more than one location. It is important to note that it is still not permissible for an employee to work for the same employer for more than six months in any one location.
